2. General rules of using the SARA DESIGN online shop

2.1. The online shop may be used only by persons who are at least 18 years old.

2.2. Anyone under 18 may use the online shop only with the consent of their parents or legal guardians.

2.3. Anyone who registers and shops in the online shop gives their personal data and agrees to their processing by SARA DESIGN on the terms as defined in the Privacy Policy.

3. Order placement

3.1.  Orders are accepted through www.saradesign.sk

3.2.  The products in the online shop are specifically marked. The website includes information about the features of the products and their prices.

3.  While ordering a product, the Customer selects it in a manner specific for that product, defining in particular its size, color, and, if necessary, providing other specific information and the quantity of the ordered products.  

4. How to buy in the online shop – a guide

4.1    Once the Customer chooses a product, the „Add to cart” icon should be clicked.

4.2       The product is moved to the basket that becomes visible after clicking the basket icon in the upper right corner of the site or clicking View Cart. The Customer can go to the basket by clicking the button, which activates a page displaying all the products in the basket.

4.3       „Proceed to checkout“ button option will launch a page where the Customer should enter data required for the transaction and shipment of the ordered products.

4.4      The Client places the order by clicking the „Place Order” button or „Proceed to PayPal“

4.5 After completing the order, the Client will receive an email containing the invoice requesting a direct bank transfer. In the case of the PayPal payment method, the client follows instructions. 

4.6     At any stage of the order placement, the Customer can cancel the order by discontinuing the ordering process and leaving the ordering website.

4.7     SARA DESIGN may contact the Customer at the e-mail address or the indicated phone number to clarify any doubt, confirm the order placement, or in any other matters connected with order processing. 

5. Prices

5.1       The prices in the online shop are stated in Euro.

5.2       The price of the product is increased by the shipping cost, which depends on the selected shipping.

5.3       The price specified on the site at the moment of placing the order is the final price, binding both upon the Customer and SARA DESIGN. Once the order is placed, the price will not change, notwithstanding any price adjustments made by SARA DESIGN and regardless of any special offers or clearance sale campaigns.

5.4       SARA DESIGN reserves the right to change the prices of the products available in the online shop, launch new products, launch and cancel special offers on the shop’s websites or change them in line with the Civil Code and other applicable laws. 

6. Availability of the ordered products

6.1       All the products offered in the online shop are in stock or may be pre-ordered.

6.2       In special cases, e.g. if many Customers order the same product simultaneously, the product may not be available. If this is the case, the Customer will be informed that the order cannot be processed.

7. Inability to process an order

If the order cannot be processed for any reason, the Customer will be notified via e-mail or phone about any order processing issues and possible solutions.

8. Shipping method and order lead time

Goods are shipped worldwide and are delivered via national mail service. Average delivery time for the international standard shipping is 5-15 days. Alternatively, courier service is delivered within one week in Europe.

9. Order payment methods

9.1     Direct payment method – direct transfer on the bank account (all details will be sent to the client via email.

9.2     Paypal – client follows the instructions of the provider

10. Sales contract

10.1    The information available on www.saradesign.sk does not constitute an offer within the meaning of the Civil Code.

10.2     The Contract is entered into in English.

11. Shipping cost

11.1     Goods are shipped worldwide via national post (Slovak Post) or Courier service.

11.2    Prices for shipping are calculated in Order Cart

11.3    In case if any restrictions in postal services, SARA DESIGN immediately inform the client and agree on the other method in shipping.

12. Contract rescission

12.1     The Customer has the right to rescind the sales contract within 14 days without cause only if the product is not made specially for customers measurements and design requirements.

12.2     The right of rescission expires 30 days of the day on which the Customer came into possession of the products or a third party specified by the Customer and other than the carrier came into possession of the product.

12.3     To exercise the right of rescission, the Customer must submit a clear notice of rescission to SARA DESIGN by e-mail to: saradesignfashion@gmail.com

12.4     To make sure that the rescission deadline is adhered to, it is enough for the Customer to send the notice on exercising their right to rescind the contract before the expiry of the rescission deadline.

12.5     In the event of sales contract rescission, SARA DESIGN refunds all the received payments to the Customer, including the costs of delivering a product without undue delay, and in no case later than 14 days after the date when SARA DESIGN received the Customer’s notice on exercising their right to rescind the sales contract.

12.6     The refund shall be made using the same payment channel as was used by the Customer in the original transaction unless the Customer has explicitly agreed to another solution. In any case, the Customer will bear no charges connected with that refund.

12.7    SARA DESIGN may withhold the refund until it receives the product back or until the Customer provides proof of sending the product back, whichever takes place first.

12.8.    Products shall be sent to the following address: SARA DESIGN, Langsfeldova 1, 03601 Martin, Slovakia without undue delay, and in no case later than 14 days after the date when the Customer informed SARA DESIGN about exercising their right to rescind the sales contract. The deadline is met if the Customer sends the products before the expiry of the 14-day time limit.

12.9     The product must be returned at the Customer’s option at their own cost.

12.10   The Customer will be liable for the diminished value of the product resulting from its being used otherwise than as necessary to determine the nature, features, and functioning of the product.

13. Complaints

13.1      The sales involve new products free of defects. If the products have any defects, SARA DESIGN shall be liable for the defects.

13.2     A complaint can be sent via email: saradesignfashion@gmail.com or by post to SARA DESIGN, Langsfeldova 1, 03601 Martin, Slovakia.

13.3    SARA DESIGN shall examine the complaint within 14 days and shall inform the Customer about the outcome.

13.7     If the outcome of the complaint is positive, the Customer will be reimbursed for any reasonable costs of shipping the defective products to the online shop.

13.8     If the outcome of the complaint is negative, the goods will be shipped back to the Customer with a notice explaining that the complaint was deemed unfounded.

14. Order termination

The Customer may cancel the order by contacting SARA DESIGN via email: saradesignfashion@gmail.com

15. Miscellaneous

Proof of purchase is enclosed in the email and will be sent to the Customer if requested.

15.1. Personal data processing

The Customer’s consent to SARA DESIGN’s processing of personal data is voluntary but failure to grant the consent to the personal data processing makes it impossible to register and shop in the online shop. Any information about personal data processing is available in the Privacy Policy.  

15.2. Personal data processing for marketing purposes

The Customer may agree to the processing of their personal data and entrusting of the data to a third party to receive commercial information from SARA DESIGN e.g. about special offers.

16. Alternative Dispute Resolution

16.1      The Customer has the right to contact the Seller with a request for redress by e-mail to saradesignfashion@gmail.com if he is not satisfied with the way in which the Seller handled his complaint or believes that the Seller has violated his rights. If the seller responds to this request in the negative or does not respond to it within 30 days of its dispatch, the Consumer has the right to file a motion to initiate alternative dispute resolution of the subject of alternative dispute resolution (hereinafter ADR entity) under Act 391/2015 Coll. ADR entities are bodies and authorized legal entities according to § 3 of Act no. 391/2018 Coll. The Consumer may submit the proposal in the manner specified pursuant to § 12 of Act no. 391/2018 Coll.

16.2     The Consumer can also file a complaint through the RSO Alternative Dispute Resolution Platform, which is available online at: http://ec.europa.eu/consumers/odr/index_en.htm

16.3     Alternative Dispute Resolution can only be used by the Consumer – a natural person who, in concluding and performing a consumer contract, is not acting within the scope of his business, employment or profession. Alternative dispute resolution only concerns a dispute between the Consumer and the Seller, arising from a consumer contract or related to a consumer contract. Alternative dispute resolution only applies to distance contracts.

17. Final provisions

17.1     The relevant provisions of the Civil Code, Act no., Shall apply to relations not regulated by these Business and Complaint Conditions. 22/2004 Coll. on electronic commerce and amending Act no. 128/2002 Coll. on state control of the internal market in matters of consumer protection and on amendments to certain laws as amended by Act no. 284/2002 Coll. as amended and Act no. 102/2014 Coll. on consumer protection in distance selling.

17.2     The supervisory body is the Slovak Trade Inspection Authority (SOI).

17.3     The consumer has the opportunity to turn to the ARD.

17.4     These business and complaint conditions take effect against the Buyer by concluding the Purchase Agreement. Applicable law These Business and Complaint Conditions, as well as the Purchase Agreement, are governed by the laws of the Slovak Republic.
